El daño colateral será la obligación para todos los propietario de viviendas que se vendan o alquilen deberán contar con este documento que refleje lo eficiente que es su casa en cuanto al consumo energético. este requisito será de aplicación previsiblemente antes del próximo año, puesto que actualmente la ley se encuentra en tramitación
El borrador de real decreto con el que trabaja el ministerio de industria indica que el certificado de eficiencia energética ha de ser otorgado por un técnicohabilitado para la realización de proyectos de edificación o de sus instalaciones térmicas, en base a un programa informático de certificación reconocido oficialmente.

Todo dependerá de las exigencias en cuanto a la Normativa de tú Comunidad Autónoma (Cuando se aprueben). Inicialmente, es únicamente para nuevos contratos en alquiler, cuyo desembolso irá a cargo del Titular Registral del bien.
